Reporting Inappropriate Behaviour
The business company KOVOP, spol. s r.o., ID No.: 255 53 925, with its registered office at č.p. 110, 687 12 Kněžpole (hereinafter referred to as the "Company"), has established its own internal reporting system as a mandatory entity pursuant to Act No. 171/2023 Coll., on the protection of whistleblowers, as amended (hereinafter referred to as the "Whistleblower Protection Act" or the "Act"). Part of the established system is the possibility to submit reports on actions described below.
Reports can be submitted by all persons who perform dependent work for the Company in a basic employment relationship, volunteer work, professional practice or internship and know and/or otherwise learn about, or suspect unlawful conduct, the list of which is provided in the Act (hereinafter referred to as the "Whistleblower"). To eliminate any doubts, the Company states that reports made by other persons, including those who perform activities for the Company as specified in § 2, paragraph 2, letters c) to g) and j) of the Act, are excluded and the Company will not deal with these within the evaluation under the Act.
It is important that the report is based on credible facts and circumstances. A fine may be imposed for knowingly false reports according to the Act.
What kind of conduct can be reported, for example?
- has the characteristics of a criminal offence;
- has the characteristics of committing an offence for which the legal regulation stipulates a fine, the upper limit of which is at least 100,000 CZK;
- violates the law on the protection of whistleblowers;
- violates legal regulations or European Union regulations in the field of financial services, mandatory audit and other verification services, financial products and financial markets;
- violates legal regulations or European Union regulations in the field of corporate income tax, prevention of money laundering and terrorist financing, consumer protection, transport safety, transportation and operation on roads, environmental protection, food and feed safety and animal protection and their health, radiation protection and nuclear safety, competition, public auctions and public procurement, protection of public order and safety, life and health;
- violates legal regulations in the field of personal data protection, privacy and security of electronic communications networks and information systems, protection of the financial interests of the European Union or the functioning of the internal market, including protection of competition and state aid under European Union law.
Who receives the report and how can it be submitted?
Your report will be received by our designated person: Jana Salvetová, via email: oznameni@kovop.cz, by phone at: +420 771 242 680, or also in person at the Company's headquarters or at another location determined based on an agreement with the report handler. You will be allowed to submit the report within a reasonable period after submitting your request, but no later than 30 days.
When making a report, it is necessary to provide your name, surname, and date of birth (or other data from which identity can be inferred) and information about possible unlawful conduct. The designated person is bound by confidentiality and will protect your identity and the information you have provided.
If you suspect unlawful conduct, we would appreciate it if you use the Company's internal reporting system. In addition to this, the law allows you to use other means of reporting through the Ministry of Justice's reporting system, which is available at this address: https://oznamovatel.justice.cz/, or through publication, for example in the media (but only in cases listed in § 7 paragraph 1 letter c) of the Whistleblower Protection Act).
Method of handling reports
We will confirm receipt of your report within seven calendar days of its receipt, unless you have requested the authorised person not to be notified of the receipt of the report, the report was made anonymously (without us knowing the specific address to which we can respond), or it is clear that notifying you of the receipt of the report would reveal your identity.
The authorised person will then investigate the circumstances of the reported conduct. Subsequently, they will propose measures to prevent the continuation of the reported conduct and to rectify the situation. The implementation and execution of these measures are also monitored by the resolver. We assure you that the Company will not take any retaliatory measures against you or so-called related persons in connection with the submission of the report, such as termination of employment, reduction of salary or other disadvantages, termination of permanent cooperation or, for example, reduction of remuneration.
No later than 30 days after receipt of the report, the authorised person will inform you of how the report was assessed (whether it was justified or not). In complex cases, the deadline may be extended by up to 30 days, twice in succession. Once specific measures have been taken, the authorised person will inform you without undue delay, unless you have requested the authorised person not to be notified of the receipt of the report, or it is clear that notifying you of the receipt of the report would reveal your identity.
